LBUSD School Board Now Accepting Applications for Trustee Area 1

As of March 15, 2021 The Los Banos Unified School District put out a public notice on the District's Facebook page announcing that they are seeking applications from interested personal seeking to serve as a trustee on the board representing District 1 until November 2022.

The application period began on March 15, 2021, and applications must be submitted by 12:00 noon, Tuesday, April 6, 2021. Interested persons can obtain an application form from the Los Banos Unified School District Office located at 1717 So. 11th Street, Los Banos, CA 93635.

The only requirements to serve on the board are:

  • The individual resides in their district, in this case District 1.

  • The individual is a registered voter, registered to vote in their district, in this case District 1.

  • The individual is not employed by the Los Banos Unified School District

The procedural process of appointing an applicant are guided by Education Codes Section 5090-5095.

Per the Ed. Code Board By Laws regarding provisional appointments it states the following:

"Provisional Appointments When authorized by law to make a provisional appointment to fill a vacancy on the Board, the Board shall advertise in the local media to solicit candidate applications or nominations. A committee consisting of less than a quorum of the Board shall ensure that applicants are eligible for Board membership and announce the names of the eligible candidates. The Board shall interview the candidates at a public meeting, accept oral or written public input, and select the provisional appointee by a majority vote."

From this and recent previous appointments we can tell a few things about the application process:

The Board must interview all eligible candidates that meet the criteria listed above.

  • The interviews will be held in a public meeting (Online due to COVID-19)

  • Candidates will each be asked the same questions.

  • Candidates will each have the same amount of time to answer their questions

  • Candidates will not be allowed to hear other candidate's responses

  • The order in which candidates interview will be random

  • A candidate will need 4 votes in order to be appointed.

If no candidate reaches a majority vote of 4 yes's i.e. "a majority vote" then by default the District will be forced to hold a special election.

On March 16, 2021 the LBUSD Board of trustees voted unanimously to approve the recommendation from staff to appoint 3 trustees to an Ad Hoc subcommittee to screen applicants prior to the April 15, 2021 board meeting. Board President Ray Martinez appointed 3 trustees to the Ad Hoc subcommittee which are trustee Jessica Muran, trustee Marlene Smith, and himself, trustee Ray Martinez. Before the vote was held, Board President Martinez reiterated that the subcommittee is only verifying information of applicants and nothing more. The committee would ensure that applicants meet the requirements such as living in the district, being a registered voter, etc. This committee has no power to prevent an eligible candidate from proceeding forward in the process, but simply exists to eliminate candidates who are ineligible.

A date for when the interviews will take place has not yet been released. It would most likely be a special board meeting all of its own as opposed to part of the April 15, 2021 regularly scheduled meeting. Depending on the number of applicants these meetings can take an hour or more, and so they rarely are held in conjunction with regularly scheduled meetings.
